Plaintiff is the owner of a trademark “CALMPOSE” for a medicine. It was alleged by the plaintiff that the defendant started manufacturing a similar medicine under the mark “CALMPROSE”. It was held by the court that both the marks “CALMPOSE” & “CALMPROSE” are used for the same class of products and that they are both phonetically and visually similar and hence was held to be deceptively similar.
